Cedro Sdn Bhd, a corporation established in accordance with Malaysian laws, is responsible for issuing illy Gift Cards in Malaysia. These Gift Card Terms govern all digital illy Gift Cards (referred to as “Gift Cards” or “Gift Card” in the plural and singular respectively) that are purchased, obtained, redeemed, or used within Malaysia and its associated regions. By purchasing, accepting, or using a Gift Card, you agree to abide by and comply with these Gift Card Terms. In these Gift Card Terms, “illy”, “we”, and “our” refer to Cedro Sdn Bhd or its related entities.

You can use Gift Cards to buy eligible products and services online only at illy.my within Malaysia and its territories, or certain associated properties. We have the discretion to alter which products and services are eligible, as well as the affiliated properties. If the cost of your purchase exceeds the amount on the Gift Card, you will need to use an alternative payment method to pay the remaining balance. Any unused balance on the Gift Card after redeeming can be kept and used for future purchases.

Gift Cards are unable to be returned, resold, cancelled, or used to buy other gift cards. They cannot be redeemed for more than their face value, transferred for any value, or exchanged for cash or a cash refund, except as required by law. Additionally, Gift Cards should not be used for unauthorized advertising, marketing, sweepstakes, promotional, or commercial purposes. It’s important to note that Gift Cards cannot be used to purchase goods or services at any illy or illy-affiliated properties outside of Malaysia. They are exclusively applicable within illy.my that is the responsibility of Cedro Sdn Bhd. Gift cards are unable to be used for international orders.

Should you breach any of these Gift Card Terms, utilize a Gift Card for a purchase in a fraudulent, illegal, or contrary manner to these Gift Card Terms, or use any Gift Card in a manner that we believe to be harmful to illy or Cedro Sdn Bhd, its associates, or its customers, we may cancel, withhold, invalidate, or reject such Gift Cards without reimbursing you, freeze or terminate accounts, cease or terminate access to our services, cancel or limit orders, and demand payment from alternative payment methods, without prior notification.

Once we electronically transmit the Gift Card to you or your specified recipient, deliver it to the carrier, or at the time of purchase for in-person transactions, the responsibility and ownership for the Gift Card transfers to the purchaser. illy.my or an authorized third party must be the source of the Gift Card. You are liable for ensuring the safety of your Gift Card to prevent unauthorized use. In case of loss, theft, destruction, or any unauthorized usage of the Gift Card, illy and Cedro Sdn Bhd are not liable. Additionally, illy and Cedro Sdn Bhd will not be held accountable for any fraudulent or illegal activities carried out by any third party concerning any Gift Card.

Gift cards are offered “as is.” illy Malaysia and Cedro Sdn Bhd do not guarantee or imply any express or implied warranties, including those of merchantability or fitness for a specific purpose, regarding gift cards. There’s no guarantee that a gift card will always be accessible or accepted. To the fullest extent allowed by law, we and our vendors won’t be responsible for any damages, losses, or claims of any kind that arise from using or possessing gift cards. If Cedro Sdn Bhd is deemed liable to you, your sole compensation will be limited to recovering actual and direct damages, which cannot exceed the last balance on your gift card, to the fullest extent permitted by law.

All issues concerning Gift Cards between you and illy Malaysia will be subject to the laws of Malaysia in their entirety, irrespective of the choice of law provisions of Malaysia or any other jurisdiction.
Unless prohibited by the relevant law and in addition to the statutory rights for consumers, you consent that any and all disputes, claims, or legal actions that arise either directly or indirectly in relation to Gift Cards (including any purchases carried out with the Gift Cards) will be settled individually, without resorting to any class action, and solely in the state or federal courts situated in Malaysia.

We retain the right to modify these Terms and Conditions for Gift Cards at any time, at our sole discretion and without prior notice. The terms and conditions remain valid to the extent permitted by law. In case any of these terms or conditions are considered void, invalid or unenforceable, such a term or condition will be viewed as separate and will not affect the enforceability or validity of the remaining terms and conditions.
